The Centers for Medicare & Medicaid Services (CMS) just completed a number of revisions to the Requirements of Participation (ROP), which will become effective November 28, 2016, and will be implemented in phases over the next three years. Updates to these Requirements had not taken place since 1991, thus resulting in a number of significant changes.
One such change pertains to pre-dispute arbitration agreements. Unless the National Associations are successful in obtaining a preliminary injunction prior to November 27, 2016, operators will no longer be able to use these effective November 28, 2016. Another important highlight involves behavioral health and staff competency requirements.
