There have been recent publications from EEOC/ADA regarding workplace wellness programs that collect employee health information. This month the U.S. Equal Employment Opportunity Commission (EEOC) published a sample notice to inform employees on what information will be collected, how it will be used, who will receive it, and what will be done to keep it confidential. This notice (Sample Notice for Employer-Sponsored Wellness Programs) is required for all wellness programs collecting health information effective the beginning of the 2017 plan year.
Other recent rules outline how to calculate the allowed amount of wellness incentives and the taxability of wellness incentives taxability of wellness incentives.
